Yeah, nice one. I have to wonder if Jody is really "Above the Fray," or if the sleeper wave contained within the t&c could still wash over him... hmm. As L said, I could swear I'd seen that photo before. Oh well. ;-l

BTW, $1K shopping spree for a full page print ad, plus all rights in all media in perpetuity blah blah blah... is what we call crap rates, aka: rights grab. Those terms are atrocious. The winner here is Mtn Hardwear. Sorry Jody. I still think your photos are winners though.

Edit: Could probably argue that "published" wording. Also, just because the content's the same, it might not be the exact same photo.

It's pretty clear: "To qualify, your entry and related materials must: ... Not have been previously published, made publicly available in any manner whatsoever, or submitted in connection with any other contest or promotion."

I'd assume that includes the internet.

Jerry - interesting comments. But there is no evidence that his 2 images have been used before.
Clicking on that link to Jody's thread shows a near-identical photo, but it's not the same image.

So technically you (and L) are wrong. Nice try, though...
