These issues come up frequently. If these guys were so smart, they'd know that when you purchase title to property, you also purchase all easements, written or unwritten, appurtenant to that property.
It is also interesting to note that in property law, of all the various rights to property, unwritten rights are the highest.

Hi Gary,
I thought the same thing at first, but after reading some more about the situation at Martins beach, it wasn't quite as clear as I first thought. The case was no slam dunk, and Khosla is a powerful man with... Billions. He won an initial trial on the public nature of the beach.
The history of the property was pretty interesting. Goes way back and the case considered a Mexican 1848 treaty.
I'll be sure to get down and surf it this winter. Haven't been there in 10 years.
