Seems to me that Plaxico Burris got HOSED... 2 years jail for an EXPIRED permit. I can certainly understand and condone jail time for NO permit but this guy had jumped through the hoops, got the permit and then let it expire.. Seems pretty brutal punishment to me. The one they should have gone after was whomever the instructor was who passed him on the gun safty part of that permit process!!

Did he get jail time for the expired permit... or for shooting himself in the leg and endangering everyone else in the club?

expired permit from another state.....which STILL would not have allowed him to bring the gun into a nightclub.

this is not the guy you want to use when it comes to arguing for gun rights.

One of the most frequent refrains I hear from gun rights advocates is that there is no need for additional regulation, we just need to enforce what's on the books better.

Well, here's a clear case of enforcing whats on the books and using a doofus as an example.

what if he accidentally shot someone else? Would 2 years be excessive then? He endangered everyone who was near him, so no I do not think it is excessive.

Poor guy is so misunderstood.
He was just trying to perform a public service keeping bad dancers off the floor.
At least he's not as stupid as that guy that found a .45 in the glove box while waiting in his friend's truck, shot himself in the foot, freaked out, pulled the trigger again, and got the other foot.

In the old days, if it came to trouble, we used to just throw down with our meat hooks and preferred to win or get beat on the strength of our will.

NFL show-off + ignorance + fool with gun = jail time.

He's an idiot, and he got the mandatory minimum, fine, whatever. Sucks for him, but he was stupid.

On the other hand, he was sentenced to more time than Michael Vick.

Seemed fair to me...

NYC put laws on the books to clean up it's image and it's crime rate and it worked. Like Aya said, he go the mandatory minimum.

How about the guy who got 30 days for killing a guy while drunk driving even though NFL players are all covered by dial a ride.

Was not looking at this from a gun rights perspective but was looking at the paperwork angle. As far as i know the 2 years was for the permit violation. I see a huge difference between an expired permit and never had a permit. I was not aware that the permit was from a diferent state.

Also not defending the guys intelegence. Just seems like 2 years in maximum security PRISON is a lot of time for just being stupid! They do say that life is tough when your stupid though....

Why do you think he will be in a maximum security prison?

A 2-year sentence seems very high to me; I can see the logic of going after people who are carrying guns to use in committing (other) crimes, not so much in going after someone carrying a gun to defend himself.
A would have given him a slap-on-the-wrist: if any jail time, just weekenders or something like that.

sure we do. someone who gets a DUI is punished because they endangered the public whether or not they caused an accident. Because driving after drinking is inherently dangerous. Just like carrying a loaded gun into a crowded night club, when you clearly are not smart enough to handle it safely is inherently dangerous.

He was just admitted to Rikers Island, Pretty shure that is the big house! A guy who has done the background checks and gone through the paperwork process is a totaly diferent animal from the guy who bought the gun in a back ally. I feel the sentance is absurd. I got a ticket a few years ago for an expired drivers licence and the cop told me to get it renewed tomorrow and I will tear up the ticket. I i had never had a drivers licence he probobly would have buckeled me up and given me a ride down town.

Charges like reckless endangerment, attempted murder, etc are "what if" charges.

This guy is a stupid sh*t and gives responsible gun owners a bad name. Knott my poster boy for sure.

Of course you do. Why do you think they arrest and lock up drunk drivers. You just don't let them drive around until they kill someone. I'd like to see a drunk driver argue for a lighter sentence because they only injured themselves.

Actually, he got off light. I you read the judges sentencing document, you will see that he only got six months for the gun crime, but an additional eighteen months for using the name "Plaxico"....

Lest we not forget his sidekick that night, his team mate, the linebacker. This good pal took the offending firearm back to New Jersey, then had his lawyer try to use it as bargaining leverage for immunity. Those guys with the robes just love when you try to strongarm the law.
His defense should be "Wouldn't you help your friend out"

I think the guy was an idiot and a dangerous idiot but fer christ sake people serve less time for vehiculer manslaughter. the intent of the law is to give mandatory jail time to hoods with illeagle guns that are used for knocking off liquor stores and gangbanging etc. this gun was purchaced legaly, the paper work was in order but then expired. that is a whole diferent level of violation INMOP from the gun bought in a back alley and carried with the intent to commit a crime. Stupid, hell yes. Dangerous, hell yes! deserving of some jail time? probobly. 2 years of your life is a lond time for a crime that was not commited with bad intent. Look at your own life, think of all that you have accomplished in the last 2 years and then think of that same time in jail. then you can spray about sending annother human to jail for that same ammount of time think about what that will accomplish good or bad... the guy allready lost his job....

One of the guys from E company 506th Regement 101st Airborn made it throgh all kinds of crazy combat from Normandy to Holland and Overloard and then finaly the Ardens. He got a Luger off of a German officer, stuck it in his pants, shot himself in the femural artery and bled out.. True story, not Hollywood. When my dad was on the ship headded for WWll one of the guys shot himself in the foot with a .45acp with the intent of getting out of combat. He ended up getting a blood clot or some sort of complication from the foot wound and dying...

Lugers are cool but they're not THAT cool.

For one thing; if the krauts captured you with one you were shot on the spot.






Nice instinctive shooters, but too many moving parts, tolerances to tight for grit in the field, underpowered (though still quite lethal).
One guy who posts here thinks waist packs are fruity and carries inside the pants, but I say "Who's the fruit? And who's gonna be the fruitee?"

My dad brought a P38 back but pawned it allong with his medals for drinking money in NYC BITD When i read tha account of that Paratrooper shooting himself in the thigh and bleading out it floored me because of all the stuff the guy had been through up to that point. Won't EVER catch me carrying with one up just stuck in the belt ever again. after reading that little bit..
