This is covered in the Fourth Amendment!!!
No illegal searches or seizures. Period


What this is, is called "Right Wing Police State Tyranny"
Its a product of Right Wing Rule, this is always the end game of their agenda.

It's the opposite of Soft Tyranny, That huge Threat to America as espoused by Mark Levin, making someone pay taxes.

While I do think that the ruling about strip searches was not in keeping with the constitution, it should be noted that this applied to a case where an individual was being moved into a holding facility with other inmates and that the institution in question had always strip searched everyone as a matter of policy to avoid contraband being brought in. This one guy happened to be a lesser offender who really did get bad treatment because of a paperwork mistake of some sort.

This was not a roadside strip search by an overzealous cop.

I believe that the ruling was made in this specific context and that in this specific context was it legal.

Again, I do not agree with the ruling it but your posts are at least a tiny bit suggesting that this ruling has more reach than it really has.

Maybe it is a slippery slope issue or maybe this situation should not have resulted in this ruling. But prison guards are in a very dangerous place and they do need to take precautions just like cops on the road who walk up to your car with their hand on their gun.

Define "illegal" in this case. The person appeared to have an outstanding warrant for his arrest that was severe enough to get him arrested and taken away in handcuffs. If he had an outstanding warrant that was real and he had failed to appear when required, should he then be treated like any other inmate at the facility where he was searched? Failure to appear is not how law abiding citizens behave.

Should an institution leave it up to individuals to decide who "looks" like they should be searched and who does not or should they just have an overall policy of treating all jail inmates the same?

It sucks for this guy but none of the other criminals who deserved to be there had law suits about their searches. If those searches are legal than this one, in the context of that situation would be legal too. Either that or all of the inmates are being treated illegally.

Dr. F,

I took many people to the jail at sheriff stations for minor offences and very very few were strip searched because it was clear they would make bail from the station. Only those being transfered to the main jail, where serious offenders are housed are strip searched.

I thought the guy DID have an outstanding warrant out for him when he was stopped.

The tragedy is that he should not have had the warrant because he had already paid
the parking tickets and that was not entered in the computer system by the time he was stopped and arrested.

I only read the decision very quickly, please correct me if I have the case facts wrong.

This is why Politics is important!!!

Many People say they don't care, it doesn't matter.
But it does, if Dr. Sprock gets strip searched, It's not because the Liberals won
Its because they Lost, and the Right Wingers are turning this place into a Police State, where anything goes.

The Right Wingers are Not about letting you do whatever you want, they are for Telling you what is good or Bad.

To them, Climbing and Climbers are Bad, put a stop to this unproductive nonsense,
those rocks belong to anyone that wants to Make Big bucks, just pay off your local Republican Representative, and they are yours to quarry.

As far as the strip searches go
Yes, this is an isolated case
But you see it everyday on TV,

I was just watching Vangaurd TV, about the Pot Wars in New York City
The Cops pull anyone (meaning black) over they want and search them illegally
find pot, and send them directly to jail!!
Even though its Just a Misdemeanor for pot possession in the state
Its completely out of control, and illegal.

There were something like 800,000 illegal searches in the last 5 years!!

It would be heaven for TheStool, he could do all tooling his heart desired,
and bash heads in everyday, stop those Bad (black) people, they have Pot, kill.

I am a right winger and I think Climbing and Climbers are good, you are delusional.


I also used to stop people for tail lights, license plate lights and sometimes search their car because of suspicious actions, language or attitude. Oh, I didn't care if they were white, pink, brown, black, green, orange, I was an equal opportunity tooler.

I worked at two stations with primarily black or hispanic populations, some of the nicest people I've ever met, and a few of the worst. I tooled them the same way I tooled movie stars in Malibu.


Back to politics, this should be a good day for Romney.

People will surely warm to Mittens as they get to know him in the months ahead.



I expect Romney to beat Obama in an electoral landslide.

This thread is BS on a climbing forum, but all the posts attest to its popularity, and golly, I want to be popular, too. Reminds me of talk radio...everybody's got an opinion, (as well as a similar body part). Doesn't matter if the opinion is informed or based on facts..."it's my opinion and if you don't agree you are not only stupid, but an a**hole, too." Not a real strong arguement for anybody. (Not sure if I spelled arguement correctly, but am going to leave it in case someone cares to divine my political leanings based on my ability to spell).
I like to listen to Right Wing Talk in the AM (until I can't stand it anymore), and Left Wing Talk in the PM (until I can't stand it anymore). Here's a fun radio game...if you are in a market that receives both, set one station to Rush, and the other to Ed Schultz; then switch back and forth real fast.....you cannot tell the difference between the strident ideologic diatribes!
And as regards blanket statements and the thread title, how about the EPA? I'm pretty sure Richard Nixon was some sort of Republican. Everything? Really? Can I therefore assume Democrats are right about everything? What about the Greens? And the Commies? And the Nazis? Are they right about a few things? What things?
Sorry if I'm repeating made points....no way am I going to read all these comments.

The Chevy Volt was first introduced as a concept vehicle in January 2007, fully two years before President Obama took office. And the substantial tax incentives for purchasing high efficiency and plug-in vehicles like the Volt were passed under President George W. Bush.


Former President and Romney campaign surrogate George H. W. Bush just this past week bought a Volt for his son Neil.
