Why did RokJox's most recent meltdown get yanked? It can't be posted to and has disappeared from the actual list

I'm screaming censorship.

And threatening lawsuits that you have no intention of following through on is immature, ahem, RJ....

If you post up pics of yourself then you have to live with it. And Ps is a fact of life, especially when you get people P'O'd.

people who feel that their right to free speech is being violated on a commercial site should give a little thought to the bigger picture...

...it is not illegal or unconstitutional to censor speech on a "privately held" web site.

While it is now apparently found unconstitutional to abridge the right of the private sector to engage in political speech, it is not unconstitutional for the private sector to limit free speech in venues that they "own."

What a wonderful thing this free market is... apparently not so free.

What's really... I was going to say weird, but I think maybe "scary" is more accurate... What's really weird/scary about the whole thing is the idea that because someone has done some photoshopping and posted a semi-obscene picture of me on the internet, a prospective employer might not hire me.

Whereas, in reality, the thing that would scare away a prospective employer is the off-the-deep end ranting and threatening that I do in response.

Maybe internet forums are like gambling, or booze, or whatever. You can sit down to a card game now and then, and it makes no impact on your life. Some folks can't control the urge to gamble, and it ruins their lives. Ditto with a glass of wine with dinner for one person, and a life in the gutter for another. Maybe there are people who just should not, under any circumstances, ever log on to a public forum.

Why does everyone assume that is legal to take other people's pictures and modify them and then republish them?

Isn't that clearly a "derivative work," the right of which to make is reserved exclusively to to the copyright owner? (See 17 U.S.C. Section 106) I know there are lots of artists who post to this site; I'm surprised they don't have a view as to whether their work can be appropriated by others without their permission.

And if the owner of this site is given notice that it is being used as a conduit to further copyright infringement and the owner refuses to prevent that, seems like it's liable for contributory infringement.

RJ should consider registering the copyright of some of his pictures before he posts them here, then post them, sit back and wait for the copyright infringement to occur, and then:
BAM, you're hit with a copyright infringement lawsuit, and he as the right to recover statutory damages and attorneys' fees.

Maybe, that's why it would be extremely helpful for the copyright owner to have registered his works before the infringing activity began. That way he can recover statutory damages and, possibly, attorneys' fees.

Nevertheless, I'm not so sure that there is no economic damage. This site contains paid advertising, and based on the responses to the threads, the posts that contain apparently infringing photos are some of the most popular on this site. Therefore, the copyright infringement is being used to draw eyeballs, for profit. Not saying I agree with that, but I see the argument . . .

No, I think it's pretty clear you have implied permission to repost photos that others have originally posted on Internet forum (that is, if nothing else, that original poster has chosen to post the photos on a site that invites commentary and replies).

The potential copyright infringement I saw was the preparation of the "derivative work" by Locker. He took RJ's photo (which is protected by copyright law, even if it isn't registered), and then he modified it to create a derivative work. Only a copyright owner has the right to prepare a derivative work (I cited to the federal law that says that above).

Locker's point that there are no damages seems good, but his actions do seem to have caused "psychic" damage--I don't know if those "count" under a claim for copyright infringement.
What if this pisses of RJ so much he goes out and does something crazy?
Lawsuits have filed for flimsier reasons, I'm sure.

Arguing about copyright law is so "yawn".

Sorry, I was trying to make it slightly interesting by hinting that that RJ may have a viable case. No one bought it.
How about a claim for good old "intentional infliction of emotional distress," or, my favorite, "outrageous conduct"?
I won't play Mr. Lawyer more than I already have--this whole thing was just so funny that I wanted to contribute--sorry it came across as buzzkill.

Locker I've loved your photo postings but honestly, I think you took things a little too far with Rokjox. For quite awhile you kept saying in the other thread that you still thought kindly of him but then you kept stuff posted that he was pretty uncomfortable with. I mean, this stuff is supposed be entertaining and in good fun, especially for the person being lampooned, but if that person is really offended and hurt then it isn't much fun anymore and I don't see the point in keep it up.

Yeah, he went off when I posted about people leaving their dogs tied up at the base of climbs or just running around while they are climbing. Climbing sure does bring out a bunch of NUTS...

No, Locker, climbing mostly brings out a bunch of really wonderful people. We've all got our problems, and none of us is perfect, but most of us try to be as decent as we can. And most of us know that it's worth accepting the imperfections of others in return for having our own imperfections accepted.

But "most of us" doesn't mean "all of us." There are a few in this community who are virulent in unwillingness to accept the differing views of others. But this particular case goes beyond even that, because here we have someone who regularly unloads all kinds of nastiness on others, but can't accept even the slightest criticism of himself.

So don't sweat it.

Sure, you maybe get carried away sometimes, and post things that would be better kept as a private giggle. But that's hardly the end of the world. If you'd posted some kind of unpleasantness about someone nice, then I'd be among those calling for your head, but to send a little message back at someone whose native language is nastiness... Who can argue with that?

I work for a fairly large company, and I have been responsible for hiring a few people over the years. When we start the hiring/screening process (we do heavy background checks), we start with basic google searches of the candidate. You see all kinds of stuff......court cases, crazy blogs, questionable Facebook profiles, psycho Twitter posts, all kinds of weird shit; and yes, random forum posts. If you see some racy pics (commonplace with 20 somethings' FB profiles), or some back and forth ribbing and banter on a forum, you assume that the person is normal. You might also assume that the person has a good sense of humor - a highly valuable trait when dealing with clients. If you see pics that are OBVIOUSLY manipulated by a third party.....non issue. However, the one thing that you ALWAYS stay away from, the major deal breaker, is a history of litigiousness. As an employer, the one thing you fear most, and avoid like the plague, is a person who has the tendency to sue. Pathetic little creature.

As one who had their legal name linked to their non-business internet crap, I can tell you it is not fun doing a Google search and seeing the bullshit come up - years later - within the first items.

You all may be right that the person this thread is yanking off about has posted some rude and mean stuff. But do you really want to have it in the back of your mind, as you watch that person struggle financially, that it was THIS stupid thread that has assisted in their difficulty in finding work? Do you really want his family, perhaps his wife, to find such a thing and then go clicking off to see what else he's had to say online? Really?

I know this is all in 8gud* fun to some of you, but my god; What wankery. Winter cabin fever is about the best I can categorize the reason for it being.

Please - Give it a rest already. Forget about the photos; just go back and delete his legal name - those who have posted it. If not as an act of kindness, then out of a favor to me. I can tell you that I do not enjoy the fact that my family can search my name and get a nice, juicy, nasty post about my private life, in an area that is pretty high on the sensitivity scale for me. Perhaps you might be doing more damage than you are imagining.

It's easy to say "Lance had it coming." I said it upthread, and it's probably true. But nonetheless, instead of just continuing to make fun of him, maybe we should all back off a bit and see what happens.

The man is obviously troubled, and his troubles are compounded by drink. He often vents unreasonable anger on this forum, but maybe what's happened in the last few days will make him realize that if he tones himself down and contributes in a positive way, then this kind of crap won't happen in the future. Who knows?

One thing I do know is that poking a caged animal with sharp sticks is no sign of maturity or humanity. We've all had a turn at telling him that it was his own uncontrolled and aggressive behavior that led to this, so maybe now is the time to say "You've paid the price, so come on back and if you make a positive contribution, you'll be welcome.

"He publicly demonstrated his unwillingness to negotiate with others, so I knew that only a hardball response would be effective and that direct contact with him would be a waste of time and tip him off to my plans."

Ironically, Fortuny was only fined $5,000 for "public disclosure of private facts" and "intrusion upon seclusion." The remaining bulk of the award — $35,001 — was for violating the plaintiff's copyright. "The Copyright Act provides for statutory damages from $750 to $35,000 per infringed work," says Mudd, but those damages "can exceed $35,000 up to an amount of $150,000 per infringed work where the conduct was willful." This means that ultimately, it was Fortuny's own "willful" conduct that increased the price he'd eventually have to pay, Mudd argues. "In general, Mr. Fortuny could have limited the amount of damages under the Copyright Act and could have significantly reduced the amount of attorney's fees throughout the course of this matter.

Well, I've always been a fan of Lockers work. I would never think to take offense to him screwing with me.

I always put my name and face on this site, because I should be held accountable to what I say. I like to think too that everyone on this site is an actual person, not just an avatar, but a man or woman typing on a keyboard somewhere not so far away. Thats why I've always preferred ST to RC.COM. The anonymity of that website has made everyone rougher around the edges, much too willing to cut someone down. Here, you don't know. They might just be someone you'd like. However most people use an anyonymous avatar to hide behind... whatever.

Maybe because of that, I think if someone asks you to pull some images of them, or to delete something you said about them, or anything that takes no effort but they ask for you should do it. It may not make sense for you, but they have their reasons. I would like to think that people would do the same for me, if for whatever reason I ask.


Now the issue of employers searching online and coming across this, well, I'm not sure what to tell you besides paranoia can spawn from overusing certain narcotics ;D


I don't have a horse in this race, so I want to stay out of it. But in the end, its frustrating that people can't just be cool.

I have personally been amazed with the harshness of your online persona at times.
Numerous people have tried to point this out to you in threads long before this mess took off.
You are, in my opinion, much better at dishing out the words than taking flak in images.
I don't believe any of these nonsense images will ever hurt you in anyway. You just have a personal problem with them.

That said, I would take them out if you asked me to. But you certainly have a way of stirring up your own hornets nest.
