Turning to fellow supertopoans, for legal advice.

A business is using a picture of me in full page ads. I have never agreed to this or even heard of it until I saw it in print.

What are my rights?

I understand laws vary state to state, this is happening in Oregon.

Thanks for any insight!

Option A:
Bitch, moan, cry, sue, post about it on the Supertopo.
Option B:
Show it to the ladies and be all like, "Check this out..." Winky.
Option C:
Crack open another Bud Light Lime and get on with your life.

Try bumping this earlier in the day/evening. If that does not work, consult an attorney.

If you have the money or s honey who's a real lawyer this can get resolved in a few ways.
The cost and who lays is why you need a good law firms' name before you make your desire to get compensation and to redress the fowl.....Leagally you may have been fair game with no expectation of privacy. Needs to be attributed ? Was a photographer paid?

you should find out who took the picture. The photographer sold them a stock picture. He should have asked you if it was ok to use your image. If the picture was taken anonymously, send them a cease and desist order.

Does the ad show your face. If you are not recognizable then there is no foul.

Along with "are you recognizable", how did they get the photo and where else has it been displayed?

I accept Paypal. Like the guy at the smog shop told me, "we have a minimum charge". Based on his rate for what he does, I'm setting mine at $450.

If you really want questions answered or to do anything about it you are going to have to talk to an attorney.
